A judge in Antigonish has ruled a Halifax man was in control of his actions when he attacked a local psychiatrist.
In a decision released Monday, a judge rejected James Timothy Cecil Barron’s claim alcohol and seizures left him with no voluntary control of his actions.
Justice Nick Scaravelli says there was not evidence to support the claim.
The decision says Barron attacked Dr. Faisal Rahman outside his Antigonish home late in the evening May 6, 2018.
Rahman found Barron inside his vehicle, Barron demanded the keys, and Rahman tried to go back into his home.
Barron blocked Rahman, tripped him to the ground, and beat him.
Rahman suffered cuts and bruises, a broken nose, and two lost teeth.
He required dental surgery to repair the damage.
Justice Scaravelli found Barron guilty of assault causing bodily harm.
